Frequently Asked Questions About DWI 

Is a DUI the same thing as a DWI?

Kind of, but technically not - people often use the terms interchangeably, but in Texas, there is a legal difference in definition. You can only get a DUI if you are under the age of 21 and have any level of alcohol in your system while operating a motor vehicle, while DWIs are reserved for those over 21 who are either over the 0.08% legal limit or impaired due to intoxication. 

How can I get my license back after a DWI?

You can appeal your license suspension within 30 days of the start of your suspension. If your appeal is successful, TxDPS will reissue your license. If your appeal is not successful, your license will be reinstated at the end of the original suspension period. There are fees associated with getting your license reinstated. Can you go to jail for a first-time DUI?

You can, though it’s far from automatic - you are innocent until proven guilty! In Texas, penalties for a first-time DWI are up to 180 days in jail and three mandatory days, up to a $2,000 fine, and the loss of your license up to a year.
